what states can you use DraftKings?
The original DraftKings fantasy sports product is available in the vast majority of US states. However, the sportsbook is available in just under half, and the online casino is only available in a handful of states.
As of 2026, more than 50% of US states now have some form of legalized online wagering and the list of DraftKings states covers most of these, but not all. We have provided details of exactly what products are legal in which states below.

DraftKings Casino states
Although sports betting is now legal in 38/50 US states and counting, online and mobile casinos are still only available in seven states. Fortunately, five of these are included in our list of DraftKings states:
- New Jersey
– The Garden State won a Supreme Court case in 2018 which paved the way for the online gambling landscape as it is today. It is still one of the most liberal gambling states and has the highest number of online casino apps available, including DraftKings.
- Pennsylvania

Long before legal sports betting and online casino games were even in the pipeline for any US state, DraftKings was a brand that offered daily fantasy sports (DFS) contests to players aged 18+ across the US.
This service is still available in most US states to this day. As DK fantasy sports is available in 45 states, it’s easier for us to list where it is not live in this case. Curiously, all five states without DraftKings DFS are clustered together geographically:

What is the legal age for DraftKings?
The age requirements can vary in each state and are slightly different for each product. However, across the board, here are the main age limits that you need to look out for in most DraftKings states:

Where is DraftKings legal outside of the US?
As well as the US, DraftKings is also legal in the bordering province of Ontario Canada. However, since the DK sports betting app went live here, the DFS sports service is no longer available.
